Attorney: Mistrial declared after juror sees article 'inconsistent' with facts

LUBBOCK, Texas -

A Lubbock District Judge declared a mistrial in a domestic violence case against former Lubbock Police Corporal Jay White, 42.

Stephen Hamilton, White's defense attorney says before jury selection a juror saw a local news article related to the case.

After the juror was chosen and told the details of the case he'd be deliberating, Hamilton says the juror had concerns of some possible bias.

Hamilton says some of the allegations made in the article were inconsistent with the facts.

"Can you imagine being accused of a crime? You might be convicted, you may lose your job, you may go to the penitentiary for heaven sakes," Hamilton said. "That should be off of evidence presented to six or 12 people in a criminal jury and subject to direct and cross examination, not from some news article that is more concerned about 'can I get more clicks to a website or can I get more ratings because I'm putting in all of these juicy tidbits' and they don't even have a clue if they're true."

No word on when a new trial is planned.
