Judge William Eichman reported the murder charge filed against a juvenile in the death of a 17-year old girl has been dropped.
Alize Henderson, 17, an honors student at the Talkington School for Young Women Leaders was stabbed last September and died in the hospital.
Jeff Nicholson, the defendant's attorney said Henderson and his client didn't know each other and a feud was sparked through social media.
He said his client is also a victim of bullying, and just hours prior to the murder, she was attacked by a friend of the murder victim outside a convenience store.
Nicholson said some of the murder victim's friends were directly involved in fueling Henderson's decision to pursue his client, and are very much responsible for what happened to her.
Nicholson also released this statement:
"After the matter at the 7/11 diffused; my client and her friends left and eventually went to my client's home. Ms. Henderson continued to pursue my client through Facebook messenger. My client was attacked by Ms. Henderson who jumped from a moving car and ran at my client who was in her own yard. My client defended herself."
"I really feel sorry for both little girls because I don't believe they had a relationship with each other going on, I don't think they knew each other really and I think this was instigated. I believe whole heartedly a lot of this was instigated by this other little girl who had attacked my client physically at a 7/11 in the hours before this happened, and there's no evidence that my client really knew Ms. Henderson or vice versa. I just believe Ms. Henderson was egged on by these little girls and I think that they are more responsible than they're ever going to be held responsible for of this particular incident and it kind of makes me mad," Nicholson said.
He said the decision was made by the DA's office after a final piece of evidence from Facebook, was made available.
He hopes the DA decides to prosecute the other teen who he said was the instigator.
